Product OK but refurbished item has very visible scratches

I am yet to use the product, but the first thing I noticed is that both LCD and front plastic panel have very visible scratches. I understand this is an item refurbished by the manufacturer, and technically the seller may not be responsible for the damage. However, all my previous experience with refurbished items is that they are like new, only with much shorter warranty and possibly shorter battery life. This one is different. Unpleasant surprise right out of the box. And - the seller does not accept returns on the refurbished items.
